Court to proceed with hearing on suit against ALABUKUN maker, Koye Odulate, Inspector General of Police, and the Attorney-General of the Federation

A federal high court sitting in Lagos has insisted on the continuation of hearing in a suit that seeks to stop the maker of ALABUKUN pain killer drug, Mr Koye Odulate, Inspector General of police, and the Attorney-General of the Federation from using the police to harass the ex-wife of Odulate, former Mrs Rihole Odulate.

In the original suit, Number FHC/L/CS/851/2022, and filed in the court of Justice A.L. Allagoa, the plaintiff (Ms Rihole) had sought reliefs from the court over police harassment. Also listed as respondents were ASP Idris Rasheed (Officer In Charge Team 8 Zone 2 Command Onikan; Csp Uba Bangajiyaadam (O/C Monitoring Unit (MTU) Zone 2 H/Q Onikan; The Assistant Inspector General Of Police (Zone 2 Command Onikan); The Inspector General Of Police. The Nigeria Police Force; Mr Uche Wigwe; Wigwe & Partners.

Recall that on 8th March 2023, the Court delivered a ruling in the suit dismissing the Preliminary Objection filed by the 1st Respondent (Mr Odulate) and directed that parties file and exchange pleadings in the suit (i.e. a statement of claim and a witness statement on oath) because the Court was of the view that the suit was not one that could be determined by affidavit evidence alone. 

At the latest proceedings in June, lawyers to Ms Rihole, Ukiri & Lijadu, drew the Court’s attention to the Applicants’ Motion for Mandatory Injunction commanding the Respondents (Mr Odulate and others) to reverse, undo, callback, withdraw or discontinue all actions taken against the Applicant including towards her prosecution.

The lawyers pointed out to the Court that the Respondents had commenced Extradition Proceedings from the UK against Ms Rihole in breach of the Order of the Court for Parties to maintain status quo ante bellum which resulted in the arrest of the Applicant.

At the hearing, lawyers asked the Court to set the Motion down for hearing and allow more time for the Parties to exchange pleadings as directed by the Court. After hearing the respective arguments of Counsel, the Court adjourned the suit to 20th July 2023for further proceedings.
